BUYER FURTHER UNDERSTANDS THAT BATTMECH CANNOT AND DOES NOT ASSUME RESPONSIBILITY FOR ANY SUCH PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE.** **ASSUMPTION OF RISK** **:** Notwithstanding the dangers, hazards, and risks involved, and in consideration Buyer agrees to assume all the risks surrounding replacing or using a battery module, modules cell or cells, or use of any and all products and or items offered or sold by BattMech in a hybrid or electric vehicle and/or in any other activities Buyer undertakes in connection therewith; and (ii) Buyer release and forever discharge BattMech, its parent company, affiliates, trustees, officers, agents, employees, and anyone acting as employees, from any and all liability for any injury, damage, loss, cost or expense (including, without limitation, reasonable attorney’s fees) of any nature that buyer at any time have or incur, arising out of or in any manner related to any loss, damage, or injury, including but not limited to suffering and death, that may be sustained by buyer or by any property belonging to buyer.
